How to sell property of late father if he died without will?
07-Jul-2023 (In Family Law)
my father passed away 5 years back without any will. He has some properties under his name. Now we want to dispose them. should we change the name before selling or we as a family can sell it without change in registration documents.
Your father’s property is already in your name as you are his son so by law you are automatically his legal heir and the property comes automatically to your mother’s name and your name equally. Hence you do not need any will or anything to sell it. you can visit the Tehsildar office for detailed procedure of doing the same.

Dear Client,
You must apply for mutation of name in the panchayat or corporation or local authority by giving a declaration that you being family members who are only legal heirs to the estate of the deceased. Property will be changed in one of the members of the family, while others giving no objection by other members. It is always better to change name before sale.
