Custody can be obtained by filing a petition under the Guardians and Wards Act before the District Judge. Welfare of the child is the test. Alternatively people approach the High Courts also by filing habeous corpus petition which are technically not maintainable but the courts entertain them with a rider that the party has to prove that custody is illegal. Courts also give visiting rights to the aggrieved parent.

You will have to file a case under the Guardianship and Wards Act seeking custody of your child from you wife. Before granting that the Court will take into aspect the factum of welfare of child and will grant the custody in your favour if you are able to demonstrate before the Court that you are in a better position to take care of the child.
