Wife not sending kids to school can we ask for custody

Query: my brother is going through divorce. his wife is at her matrimonial home. not sending kid to school since a year . please suggest what should be done
You have not mentioned kids age.. therefore the query can't be solved fully.. still whatever the age may be you have to file custody Application and also MA in family court regarding this in family court..
