Ex husband does not pay child maintenance since last 5 years.

I got divorced in 2009 and got remarried in 2011. In the mutual diverse my X was supposed to pay 16 k towards child's maintainence and some amount for me. After my remarriage he stopped paying both (He should have continued with my son's compensation as he stays with me and my new family. ) I did not make any legal claims for this till now. However I am planing to claim the whole amount now. He doesn't help in raising the son in any way. I want to make him suffer now. Can I expect some help with this.

If the issue of maintainance of the child has not been decided yet, then you should file a petition for and on behalf of your child claiming maintainance. Maintenance of a child is the joint responsibility of both the parents. The question, whether parents are divorced or not is immaterial when it comes to maintaining the child.
