First of all you secure the documentary evidences for their ailments and the treatment particulars including doctor's opinion about counselling etc. After that you apply for divorce on the grounds of mental cruelty citing the incurable ailment as another ground to support the cause for the mental cruelty meted out to you. The documents for medical treatment particulars are essential to prove your cause of action hence collect all the particulars in this regard before fling the divorce case.
