At the earliest you have to file the application to challenge the film as a copyright work by seeking injunction on release of the film. Fees structure depends upon the experience of the lawyer and his expertise rest u can get in touch with me for legal solutions

As soon as the trailer releases and there is a clear, reasonable and specific understanding of the infringing scenes or parts of your copyright, that is the right time to sue the assumed infringing party.
