Whether email considered as evidence in consumer forum

Can an email be filed as an evidence in against Ops in a case in NCDRC. If yes, what are the procedures to be followed.

yes email, audio recordings, video recordings or any other electronic evidence can be filed in the NCDRC against the parties. You just need to take the print out of the email and submit it before the at the date of hearing. Else if you want to file it before, then you will have to submit it in the Registry of NCDRC. Since NCDRC are not bound by procedural laws. However it is best suggested that an affidavit under 65B of Indian Evidence Act is taken along just in case the Court questions the veracity of the email.

Hi, the proceedings in NCDRC are as per the procedure envisaged in Indian Evidence Act, The said act has provisions of electronic evidence and so the email comes under that category. For more information and guidance meet in person.
