University not refunding session fee how to proceed legally

27-Jun-2023 (In Consumer Court Law)
I took admission in NICMAR Hyderabad by submitting admission fees in March, 2017. Later on I applied for refund after their refund deadline (i.e. after 4th May, 2017). The entrance exam for PG course (MBA) of Lucknow University held on 29th May, 2017 and the result was out by 10th June, 2017 (proof can be provided if requested). So, according to their refund policy it was impossible for me to request for withdrawal before their given deadline.I requested them to refund my first installment of upcoming session, which has not started yet, but they are refusing to do so by stating their refund policy. So, what should I do now ?

According to the UGC norms, if you seek refund of admission fee on account of your admission in a better/Superior College, the same has to be processed if the request for refund was made before commencement of the academic session. In such an event, even the seat which was initially reserved by you does not goes vacant and the College can offer it to someone else. Hence, it's a win win situation both for you and the College and thus, College is ought to process the refund.

Send them a legal notice asking them to refund. Incase they fail to, file a case in the consumer Court.
