My washing machine has been damaged after given to repair service

i have a whirlpool washing machine. it starts making huge noise and lint filter (it removes dust from clothes) stopped working from 12 feb 2017. so i complained to call centre to rectify them because i'm covered in warranty period. but they have taken machine for repair on 5th march. after 10 days they returned damaged washing machine. it is damaged due to chemical wash they said. so i returned it and asked for refund of washing machine money as in the bill Rs 19000 even its market price is 22975. but they are not refunding money. they want to replace a new washing machine of same model. but even it was new, it is not full filling its purpose. lint filter is not working from first itself and their services are so poor. so i'm not interested in taking washing machine with them. I want to know whether i can ask for refund of machine amount and compensation for causing trouble for 1 month without providing me washing machine and not repairing my washing machine for 2 months since feb 12
Here the company may not refund money as they are replacing you with a new washing machine of same model. As the machine is having a lint problem right from the beginning the company is replacing you a new machine

Usually a company does not want to refund the cost of the product if it is damaged at the first instance. They want the product to be replaced with a new one. However, in your case, since the washing machine is damaged beyond repair and there is no chance of reviving the older one and further a new washing machine which they want to provide in place of the older one is not up to your satisfaction as it is as pathetic as the older one and you want full refund of the amount paid, you can seek for full refund. Send a legal notice through a lawyer to the company citing your grievance and demand full refund of the money within 15 days. If they refund the amount fine. If not, file a complaint before the jurisdictional district consumer forum. Feel free to call me or mail me if you need my services.
