30-Dec-2023 (In Consumer Court Law)
Dear Sir, I had booked a flat at Ghaziabad by paying Rs 2.00 Lak with opposite party. Neither he deliver the flat nor refund the said money. Tehen case was filed in consumer forum for refund. Moot question is that if the opposite party does not compliance of the court order within 30 days from the date of judgement, then appeal under which section of CPA-1986 for property attachment can be filed for recovery of the same money

to begin with you can send him a legal notice asking for possession or refund of the money. if he still shows no interest in paying back the money or to give you possession then you may file a consumer complaint the the District Consumer Forum for possession of the flat.

Dear Client
You will have to file the execution application before the same forum who passed the order for getting the order executed and the application can contain the prayer for attachment of the property of the judgment debtor.
