Fraud done by online seller took money not giving product

I ordered Sony home theatre system online through ebay.So I Paid Rs.22990.few days after that seller calls me and said that the model I paid for is out of stock hence he can't provide me that model,I said then cancel my order,seller said he can't cancel my order but give me another upgraded model and requested me to buy that one,which is price for Rs.30000,hence pay extra only Rs7000 into seller bank account.i did this, but not got my product,now seller does not responds me,he cheated me.ebay says he can't help.what should I do now?
1. kindly lock a complain against the dealer in E Bay customer care
2. kindly collect the evidence of the purchase and file an FIR against E Bay and the dealer
3. Kindly file a copy of the same along with FIR receipt to consumer forum against E Bay and the dealer
be patient enough to receive the response of the consumer forum and kindly consult me with all the details as i there are provisions to handle such kind of cases as a 1st step

How many days has it been since the promised date of delivery .
