What is a proper Will Deed document process
10-Jan-2026 (In Wills / Trusts Law)
Hi Team,
I want to make a will, can I just do that on an A4 size page, print it and sign along with 2 witnesses. is this enough or do I need to follow a different process.?
A will can be drafted on aÂ
plain A4 size page and will be considered legally valid, provided it meets essential requirements under the Indian Succession Act, 1925.Â
Key Requirements for a Valid Will in India
In Writing:Â The will must be in a written form, which can be typed, printed, or handwritten on any ordinary paper. No stamp paper or mandatory registration is required for its validity.
Testamentary Capacity & Intent:Â The person making the will (testator) must be at least 18 years old, of sound mind, and not acting under any form of coercion, fraud, or undue influence.
Signature:Â The testator must sign or affix their mark (like a thumb impression) to the will.
Witnesses (Attestation): The will must be attested by at least two or more witnesses.
Each witness must have seen the testator sign or receive a personal acknowledgment of the signature from the testator.
Each witness must then sign the will in the presence of the testator, though not necessarily in the presence of the other witness.
Ideally, witnesses should be independent adults (18+) who are not beneficiaries of the will to avoid potential conflicts of interest or suspicion during future legal proceedings.
