What action can be taken against brother for not repairing the floor

According to will my father got 1st floor and his brother got ground floor . Now first floor has been damaged from inside ground floor leaf. but my father's brother don't take any action to repair their inside leaf. And we are living on first floor. And it's very dangerous to us. So legally what should we do ?

You can first send a legal notice calling upon him to repair the damaged portions. If he fails to do it, you can seek relief by filing a suit for carrying out the specific repairs. Further, you can make a complaint to the local municipal commission and the building and land officer stating that your uncle is not carrying out necessary repairs and the damaged portions are a hazard to the safety of the house as well as its occupants.
