Registration of will and related issues

My mother is in the process of finalizing her will. Is it necessary to have an executor named in the will? Who can be named as one? My mother would also like to get her will registered. We want to know the procedure for doing so. We live in east Delhi. A nd are witnesses required to be present in court at the time of registration?

The existence of an executor is somewhat necessary as someone needs to be responsible for the execution of the will when the testator is no more. Anyone could be the executor. First a will must be drafted by an advocate. Once the will is ready it must be registered at the SR office. Yes witnesses are also needed.

will can be registered and unregistered both and legally valid as well. its always advisible to go for the registered will as it prevails over the unregistered one when the same is challanged. in order to go for registered one executor needs to be mentioned and presence is also required.
