my dad write a will about transfer of property to my mother. this was not disclosed to my dad's previous family. my mom is the 2nd wife of my dad. can members of my dad's previous family file a case in court regarding this
Hello, it’s all depend on the nature of the property. If the property your father has done well is ancestor in nature, then all child of the father and having right on that property and will can be challenged but if the property is purchased by your father and it is, self acquired property, then he can write well in favour of anyone and it is valid.
Yes, your dad's previous family will also get rights in your father's property, they get a equal share in the entire schedule property. Even if it was not disclosed to your father's previous family, when they get to know about their rights over the property, then they will for sure file a particular suit in the jurisdictional civil court and will claim their rights. Even if the property is been sold pr transferred to the remaining legal heirs still they have got rights to claim their share in the property.
