Is stamp duty required on testamentary trust registration in Kolkata settling estate assets present in 3 states, as Testamentary Trust is not transfer but inheritance and continuation of ownership. Can anyone help professionally after clarifying this point? Deed draft ready almost ready. Any case laws to present to the Sub Registrar?
In the instant case you cannot create the trust by deed. You need to make a will and create the trust. The executor must pay court fees of 50k to get the will probated from the court of law after demise of the person who made the will. Please call us for more details
