17-Oct-2023 (In Wills / Trusts Law)
My father is a Secretary of the trust & as per rules & regulations of trust a person should apply to the secretary of the trust by paying fees to the trust for the membership. But few people those who are not eligible for the membership are playing mischief against the trust.

A trust is governed firstly by the trust deed that is settled by the person establishing the trust. The rights of the trustees and the provisions for membership of new persons to the trust would be expressly laid down therein. Apart from that trusts are protected from mischief by third parties under the Indian Trust Act, 1882. Before advising you on the strategy ahead, I would like to see the trust deed and would also like to know the nature of this mischief. It would be crucial in order to examine the relief that you can seek against such persons. Do get back to me with the answers I seek so that I can advise you better.
