"My father in law has one 60× 40 site built single house ". It is to be divided among his sons, daughters and wife equally, if it is self acquired property. If your mother in law is alive it cannot be divided. Consult an advocate who practice on Civil Side. Good Luck.

Firstly, regarding your father-in-law's will - since he passed away without a Will, his legal heirs have to obtain a certificate from the Civil Court to come on record as his legal heirs, after which they can transfer the property in his name (movable and immovable) as per the shares mentioned in the certificate. Secondly, your mother-in-law can create a Will now or gift property to whoever she wants to.
