Can my mother change the will if I am paying the loans?

27-Jan-2025 (In Wills / Trusts Law)
My brother and I took equal share of home loan and the house is in my mother's name. Now she keeps threatening me that she will change the will and give the whole property to my brother only. Is it possible? And if yes, would I have to pay the loan for rest 15 years too for the property I don't even own?

Since the property is in the name of your mother she is at liberty to do with it as she pleases, which includes giving it to your brother by way of a will. Although, since it is a home loan, I am assuming that the security would be the home itself. Hence, if you stop paying the instalments, the bank will forfeit only the home on which the loan has been taken. Although, do note that your credit score will take a hit. In that case, You can stop paying the remaining loan amount and then the bank will attach that property in order to recover it's loan amount, which in turn can cause your Mother and brother to give you your share. The ownership rights of this property belongs to your mother and therefore she can transfer this property to anyone.
