I am Hindu.Can I probate a Holographic WILL without any witness attestation? The testator was my unmarried 71 yrs aunty staying alone.She wrote this WILL in her own handwriting with signature.She was very sick in her last days so couldn't get the attestation done & later expired during her hospital treatment.
Yes , in some cases you can get your probate from the Court. But, your case is a tough one. Hindu law requires that every will should be attested by at least 2 witnesses. But in some exceptional circumstances once can get the will probated also. But, it totally depends upon the facts and circumstances of that particular case.
