Ancestral property for grandchildren
11-Jun-2023 (In Wills / Trusts Law)
My grandfather just passed away. He left a certain amount of ancestral land. While my grandfather and I were alive my father took more than his entitled share of this ancestral property. He lost this amount in business losses. Am I still entitled to an equal portion of the remaining ancestral property as the other surviving children and grandchildren?
Query perused. Yes being a grandson you are entitled to equal share in the ancestral property of your grandfather alongwith other class 1 legal heirs. The right to a share in an ancestral property accrues by birth itself, unlike other forms of inheritance, where legacy opens upon the death of the owner. Your father could not/should not have disposed off the share in ancestral property without consent and agreement of other coparceners. However, such disposal does not bar you of your right to claim your share in such ancestral property. Further and better particulars are needed for an effective opinion.
