Indian Stam Duty Process for Contract Agreement

06-Mar-2026 (In Tax Law)
Hello, I’m seeking assistance with Maharashtra stamp duty for a contractor agreement issued in January 2025 (annual compensation ~$72,000 USD). Since the stamping deadline has passed, could you advise on the applicable duty amount, how the penalty is calculated, and the steps required to complete late stamping? Also, can the agreement be stamped while retaining the original January 2025 effective date? Thank you.

Under the Maharashtra Stamp Act, a contractor agreement requires stamp duty (typically 0.1% to 0.5% based on contract value). Delayed stamping attracts a penalty of 2% per month on the deficit amount, capped at 400%. You can stamp it now via the Collector of Stamps to retain the January 2025 effective date; however, the document remains inadmissible in court as evidence until the full duty and penalty are paid.
