Accountant filed wrong ER-3 what action can I take.

Dear sir, We are registered with Central Excise Dept. In the F.Y. 2016-17 we are availing SSI exemption and not charging excise duty on Invoices and also not taking Cenvat Credit. But, our accountant has filed wrong ER-3 return for the quarter Apr-16 to June-16 showing duty payable and we have no option to amend this.Now concern Superintendence of Central excise asking us to pay the excise duty.Kindly advise us but to do.

You need to visit the office and request him to re-look into it. If the concerned officer denied then you may write to him marking cc to his superior regarding the same. It is always better to go through a consultant than going directly. Thanks

will glad to help you. if your accountant has erroneously filed ER-3, and now excise department is asking you to deposit the duty in that case you can file a writ petition before the High Court for quashing the demand stating your bonafide reason.
