Transfer of 498a and 406 FIR from Delhi to Lucknow
06-Aug-2023 (In Supreme Court Law)
Hello,
My wife filed 498a and 406 case in Delhi. A brief fact of the case is given below:
All the ceremony and marriage took place in lucknow, we lived together in lucknow only. Never visited or lived in Delhi with my wife. Her parental home is also in lucknow and she is working in Rajesthan as regular employee, for which I have proof also. To create Delhi jurisdiction, her brother entered into rent agreement and showed that she was living with her but actually she was working in Rajesthan.
So please guide me if this FIR can be transferred from Delhi to UP and in which court I should file the application.
Thanks
Recently supreme court has delivered a judgment that the wife can lodge complaint at any place. so on that point you are not able to get it transferred but if the facts of your case are somewhat different.
you will have to file a petition in delhi high court for queshing the same taking all these facts high court delhi may quesh the petition on the ground of lack of jurisdiction.
