Regarding reservation in UP Govt Medical colleges upto 80%

Sir, from 2011-2015 every year UP govt established 04 medical colleges in Up providing only 07 seat for General out of 85 seat in each college saying they are established under composite plan citing GO no 1493/71-1-11-G-264/2011 . in the process they surpassed 50% and depriving general students their share of seats. I would like if it can be challenged in SC for the sake of equality. Please advise fast.

Come for conference along with the said GO. Appropriate petitions will be preaped for obtaining desired order. I believe similar issue is also pending.I'll do the needful. Subhasish Bhowmick, AOR & Counsel in Supreme Court

Indeed it can be challenged before supreme court of India through a PIL under Article 32 of Constitution of India but better remedy would be not approach SC directly but rather initiate a writ at Allahabad High Court under Article 226 of Constitution of India followed by Letters Patent Appeal there and then to SC
Reaching SC directly will not help much due to
1- 226 has wider ambit that that of 32
2-It is sort of norm now that you should exhaust all options before coming to Sc provided you have such a matter where urgent SC attention is needed such as something which has national nature that is to say across nation proble

In this regards the writ petition can be filed before Supreme Court under Article 32 and notification also can be challenged. there are general guide lines for seats in each state and institution and you should have data to support your contention
