You can ask your Advocate on Record to move an application for early hearing in the proceedings is the easiest way to move your matter ahead. Many times you have a chain of ie your Advocate who is connected with Advocate on Record so have a clear picture with them. You can change your advocate on record also.

You may seek an early listing of your pending appeal, but filing a separate petition under Article 32 or Article 142 is generally not the appropriate remedy. Article 32 is meant for enforcement of fundamental rights against State action. Mere pendency of a matter before the Supreme Court, even if for several years, does not automatically give rise to a separate Article 32 petition. Article 142 is not a provision under which an independent petition can ordinarily be filed by a litigant. It is an extraordinary power exercised by the Supreme Court while deciding matters already before it. If your appeal has been pending for around 5 years, the proper course is to file an Application for Early Hearing/Listing (Expedited Hearing Application) in the pending appeal, setting out the reasons for urgency, such as prejudice caused by the delay, age, health, financial hardship, or any other exceptional circumstances. If you share your case number, the nature of the appeal (Civil/Criminal/SLP), the year of filing, and its current stage, I can advise you on the most appropriate procedural remedy and the chances of obtaining an early hearing.

It can be done by way of procedural application in the SC. I would need more details to enable such filings. You can call me or watsapp me with more details. Constitutional remedies require careful analysis before taking action before the SC. Let me know for more help.

You cannot file a separate petition under Article 32 or invoke Article 142 yourself merely to seek an early hearing of an appeal already pending before the Supreme Court. Article 32 is meant for enforcement of fundamental rights against State action and is generally not maintainable for expediting proceedings pending before the Supreme Court itself. Article 142 is a power exercisable by the Supreme Court; it is not an independent provision under which a litigant can file a separate petition. If your appeal has been pending for five years, the appropriate course is to file an Application for Early Hearing / Listing (or an Interlocutory Application seeking urgent listing) in the pending appeal, clearly setting out the reasons for urgency and the prejudice caused by the delay. If there are exceptional circumstances, those should be specifically highlighted. If you let me know the case type (Civil/Criminal), the appeal number, and the stage at which it is pending (admission/final hearing), I can advise you on the most appropriate procedural remedy.
