09-Jul-2023 (In Supreme Court Law)
I had withdrawn my application of voluntary retirement three days before actual date. My application by court was declined. How strong is my case to fight for justice at Hon'SC
If you have withdrawn your application for VRS what else relief you want from the court. Kindly specify the relief that you are seeking for, so that we can guide you well whether your case is strong or not.
Ur question is not clear as to what is the order of high court.provide details of high court order to know accurate opinion. It will depend upon facts and law taken into consideration by high court. However as a general principle, no employee can be forced not to withdraw application for voluntary retirement.
An Appeal against the order of the high court will be in the form of a Special Leave Petition, which can only be filed by an Advocate on Record. Search for a good AOR(Advocate on Record) and provide him with all your lower court documents so that he can draft your Appeal.Limitation of filing an Appeal since date of high court judgement is 60 days.
You have hardly provided any facts. In order to give you the appropriate legal advice the facts in detail need to be known and also the impugned High court order needs to be studied as the same will be challenged before the Hon'ble Supreme Court.
