Starting a new project if company has not issued my relieving letter

13-May-2023 (In Startup Law)
I worked in a startup for more than a year. last month they accused me for taking bribe from a client and asked me type my resignation letter stating that I have been involved in fraud activities so this is my last day in the company. Ever since then they have not issued my relieving letter and my remaining salary. On following up they are saying that they are investigating on the matter and cannot commit how long will this take. Now I want to start my own company which is of completely different concept, can I do that without any obstacles?

Congratulations for your new venture. Yes, you can start your new company, there is no obstacle in that. But, you must retain a copy of your resignation to your previous employer and proof of receiving of your resignation. You should also go through terms of your employee-employer contract that you would have signed with your employer.

Hi there is no problem in starting a company in the same feild.. You will have to see whetheryour appointment letter has a non compete clause or some other clause like that .You can come down for a detailed consultation if required.

Yes you can. No one can restrain you from running a legitimate business. But make sure that there is no conflict with your previous employer on this and that you do not breach any confidentiality issue or any third party IPR.
