Freelancing along with full time job. Need advice

25-May-2023 (In Startup Law)
I am a full time employee at a private consultancy firm in Delhi, India. I have a exclusivity clause in my employment contract. A company based out of Australia has requested me to prepare certain documents for them and they would pay on hourly basis. Money is good. They can not hire me as I do not have Australia working rights but they can avail my services as a freelancer. Can I work on this on my weekend when am not working for my full time employer?

Freelancers are those who are not full time employees. They take projects and file their own tax returns. It’s comparable to a professional.

There are two types of contracts

1) Contract for Service: Where you are not deemed to be an employee but based on the contract you shall provide your services.

2) Contract of Service: Where you are engaged and bound by the terms of the contract. Violation of which may amount to a civil suit.

The decision is up-to your discretion and wisdom.
