What will happen if I am unable to repay a loan?

My brother took a loan but he passed away. I lost my both parents too but I have a step-mother. Now the bank is asking to repay the loan. There are no assets in the name of my brother or I. I am a student and I don't have a job. What can I do and what will happen if I am unable to repay the loan? Please give me a solution.

A loan does not automatically transfer to family members after the borrower’s death. Liability arises only if the legal heirs inherit assets or property from the deceased. Since you have clearly stated that there are no assets in your brother’s name, and you have not inherited any property or money from him, you are not personally liable to repay his loan. The bank cannot force you to pay from your own income or future earnings. The maximum the bank can do is initiate recovery proceedings against any estate left behind by your brother. If no estate exists, the loan becomes irrecoverable, and the bank must write it off as per RBI policies. They cannot threaten, harass, or compel you, especially as you are a student with no income. Such pressure tactics violate the RBI Fair Practices Code. Politely inform the bank in writing that the borrower has passed away, attach the death certificate, and state that there is no inheritable estate. Once this is recorded, you bear no legal obligation. Your step-mother is also not liable unless she inherited property from your brother. Do not give any written admission of liability or sign any documents. Your rights are protected under law.
