Vehicle Recovery from my friend who take my vehicle now he refused.

I handed over my vehicle Volkswogan Jetta, to Mr. Prashant Kapoor . Under mutual understanding that we would transfer the ownership of the Vehicle Volkswagen Jetta as soon as possible and he would may Rs.1,00,000/- against the said transaction latest by 10/09/2018. However I regret to say that it has been more than ten months be still he failed to honor his commitment and my vehicle is still in his illegal possession.
Now upon my demand to either pay me the money which was mutually decided or give back the possession of my vehicle to myself. He has bluntly refused.
I am therefore left with no other option than to approach your good office to provide me to get the vehicle back.

You can file a private complaint in the court based on the evidences you have like sms, emails etc against your friend. However, prior to that serve a notice to him mentioning the entire history, and give a copy of the same to the police and seek acknowledgment; thereafter which you may file complaint.

You will now have to sue the person and send him a notice for failing to comply with terms of the Agreement between you and him. However, i will have to see your communications and other documents to understand the entire transaction.
