UP RERA APPELLATE GAVE LIBERTY TO FILE CASE FOR COMPENSATION

I got the order from UP RERA APPELLATE to file case in any forum for compensation on 27 th Feb 26. I got refund with interest after two months from the date given by builder. At this time value of property is too high to buy in the same locality in the refund amount. Builder couldn't got CC and OC from GDA so I decided to ask refund with interest. Can I get compensation for the difference in value of Flat.

Since the UP RERA Appellate Authority has granted you liberty to approach the appropriate forum for compensation, you may have a legal remedy to claim compensation if you can establish that the builder's delay and failure to obtain the Completion Certificate (CC) and Occupancy Certificate (OC) caused you financial loss, including the increase in property prices. Whether the difference in the flat's market value is recoverable will depend on the facts, the terms of the agreement, and the evidence supporting your claim. yes..u can file compensation case before rera under sec 71 and claim relief in case of refund matter and rera is decid matter within time bound manner and more than one ground may be raised at rera adj for compensation and as per judgement of rera tribunal, compensation can grant in case of refund
