University Refusing Fee Refund Citing Unreleased 2026-27 UGC Guideline

25-May-2026 (In Recovery Law)
I took admission in a UGC-affiliated university for 2026-27 session and paid ₹30,000 as fees. Next day I withdrew my admission as I got admission in a better university. I submitted formal withdrawal request via email and university portal. University says they will start refund process in November 2026 and are waiting for UGC to release 2026-27 session circular which has not been released yet. Is this a valid reason to delay my refund?

Since the admission was withdrawn within one day and a formal withdrawal request was submitted immediately, the university is generally expected to process the refund within a reasonable time as per applicable UGC guidelines and its refund policy. Merely stating that the 2026–27 UGC circular has not yet been issued may not by itself justify delaying the refund till November 2026. However, the university may deduct such charges as are permissible under its applicable refund policy.

No, merely waiting for a fresh UGC circular is generally not a valid ground to indefinitely delay refund, especially when you withdrew admission the very next day and before commencement of classes. UGC has consistently issued refund guidelines requiring institutions to process fee refunds within a reasonable time after withdrawal, subject to permissible deductions, if any. Since you submitted a formal withdrawal request through email and the university portal immediately, keep all records safely including fee receipt, withdrawal acknowledgment, emails and portal screenshots. First send a detailed written reminder asking them to refund the amount within a fixed time period. Mention that unnecessary delay may amount to unfair trade practice and deficiency in service. If the university still delays or refuses refund without proper justification, you may file a complaint before the appropriate Consumer Commission or approach UGC grievance portal. In many cases, courts and consumer forums have directed universities to refund fees where the seat is surrendered promptly and no substantial academic services were availed.

No, merely waiting for a future UGC circular may not justify indefinite delay. Preserve all records. If refund is denied or delayed unreasonably, you may issue a legal notice and approach the Consumer Commission for relief.
