Unauthorised Fraud UPI transaction

On 25th May I got 2 sms from HDFC & Kotak Mahindra bank that respectively Rs.100000 & Rs.13900 were transferred to an unknown person. I dialed 1930 and police found out the name, account no. of the fraudster with money being transferred to Bank of India & finally to State bank of India, Erode where it was withdrawn in bulk through cheque. Banks have raised chargeback with NPCI but police has not filed FIR when all details are known. What to do now , to get money? 0

Immediately submit a written complaint to the SP/DCP and seek registration of FIR under cyber fraud provisions. Preserve all bank records, 1930 complaint details and transaction trail. If FIR is refused, file an application before the Magistrate under Section 175(3) BNSS. Recovery depends on tracing and freezing remaining funds.

From the facts stated, it appears to be a case of cyber fraud/unauthorised transfer of funds. Since the beneficiary account details and transaction trail have already been identified and chargeback has been initiated through NPCI, immediate legal follow-up is essential. If the police are not registering an FIR despite disclosure of cognizable offences, you may submit a written complaint to the Superintendent of Police and also pursue appropriate remedies before the competent Magistrate. Simultaneously, continue following up with the concerned banks regarding the chargeback and status of the beneficiary account. Recovery of funds depends on timely legal action and preservation of the transaction trail. File a written complaint with the SP regarding the refusal to file an FIR. If they fail to act, approach the Magistrate court under Section 156(3) CrPC / 175 BNSS to order an FIR registration. Also, submit a formal dispute to the RBI Banking Ombudsman with your 1930 portal complaint proof to expedite the recovery process.
