Token Refund for rental property

I have decided to rent a home and gave a token amount. The very next day, less than 12 hours, we decided to not rent the home and informed the owner. The owner has refused to give the token amount back. This happened between 2nd and 3rd feb. I have talked and requested them to return the token, they said they would only return the token amount if they find another renter by that time. I have not taken any action as of now ie 15th Feb. What should be done to get the token amount back?
Whether the token amount is refundable depends on the terms agreed between you and the owner. If there was no written agreement stating that the token amount would be forfeited upon cancellation, the owner cannot arbitrarily refuse to return it. Since you informed the owner within a short time, you may send a legal notice demanding refund of the token amount within a specific period.
