tenant–landlord legal issue of breach of contract and unfair demand.
02-Oct-2025 (In Recovery Law)
I recently moved into a PG, paid one month’s advance and one month’s security as per the agreement. I smoke only in my room’s bathroom, and the agreement had no smoking or penalty clause. Now, the owner is demanding ₹5,000 as a penalty or asking me to vacate without refunding my money. Can I take legal action against him for this?
Your legal remedies
If the owner withholds your deposit or charges arbitrary penalties, you can:
Send a Legal Notice through a lawyer demanding refund of your advance/security.
Approach Consumer Court (PG accommodation is covered since you are paying for a service). Consumer courts often order refund + compensation for harassment.
Police Complaint (as last resort) if there is intimidation, harassment, or unlawful eviction attempts.
Bilkul, aapke case me owner ki demand illegal aur arbitrary hai. Agreement me agar no-smoking ya penalty clause hi nahi hai, to woh aap par ₹5,000 ka penalty thop nahi sakta.
Do cheezein aapke favour me hain:
Agreement binding hota hai – usme jo likha hai wahi valid hai. Agar smoking ban likha hi nahi hai, to woh aapko us ground pe na penalty de sakta hai, na hi security/advance rok sakta hai.
Consumer Protection + Civil Remedy – aap isko as an unfair trade practice or breach of agreement dikhakar Consumer Forum, Civil Court ya Police Complaint (if harassment) tak le jaa sakte ho.
Legal action ke options:
Ek legal notice bheja ja sakta hai owner ko, jisme aapka advance aur security refund ki demand hogi.
Agar woh fir bhi mana kare, to civil recovery suit ya consumer forum complaint file karke paisa vasool kiya jaa sakta hai, saath hi harassment ka compensation bhi.
Isme PG owner ki position weak hai, kyunki woh apne hi agreement ke against act kar raha hai.
Seedhi baat: agar aap chahte ho ki paisa jaldi wapas mile aur owner ko samajh aaye ki aapko lightly nahi le sakte, to aapko mere through legal notice + follow-up action karna hoga. Ye kaam aap khud online try karoge to owner ignore karega, lekin advocate notice me usko clear warning milegi.
Aap chahe to mujhe authorize kijiye, mai aapka case PG level se lekar court tak pursue karke paisa aur respect dono recover karwa dunga.
