Should I settle for a refund of Rs 40,000 less?

25-Oct-2023 (In Recovery Law)
An immigration agency took Rs 121600 (Rs 3600 for technical round, Rs 10000 for counselling round, Rs 108000 including 18 percent GST for PR services) from me. They lied to me regarding proof of funds and job promise in the beginning. After paying complete fee, I found out I have to arrange proof of funds myself. I asked for refundThey are refunding Rs 82,000. Their logic is that the technical round of Rs 3,600 and the counselling round of Rs 10,000 have already been conducted (I did avail these services from them) . Apart from that Rs 19,440 (18 percent of Rs 108,000 ) went to GST. Some of the money went to lawyer making legal agreement which they sent to me to sign and I did not signDo you think I should accept Rs 82,000? (I have already sent them legal notice after which they are offering me this amount)(They had lied regarding proof of funds in the beginning and also about job arrangement).

It's your individual call whether you want to settle for a lesser amount than you had paid. However from a practical standpoint if you are not interested in initiating legal proceedings in the form of litigation then you may want to consider it. keep in mind that litigation comes with investment of money in terms of lawyer's fees, court fees etc as well as time it will take for the matter to reach finality.

Yes you must take this amount from Them bcoz going to court for recovery will be more time consuming and you need to pay to advocate too which will be more than the unpaid dues …once u receive 82k thenceforth u can move one complaint to the concerned police station
