SALARY ATTACHMENT ORDERS IN TWO CASES

an telangana state government employee has stood surity in chit finance company. Due to default in payment the court has issued salary attachment . Accordingly the employer is deducting salary since 4 months. Now in another chit the same employee stood surity and due to default, the same court has issued salary attachment order . what is the legal position.

Once the court has already ordered salary attachment in one case, any further attachment cannot exceed the limit prescribed under Section 60(1) CPC — only one-third of the salary can be attached at a time. The second chit company must wait until the first attachment is cleared or approach the court for pro-rata adjustment. Multiple attachments for the same employee beyond the legal limit are impermissible and liable to be set aside.

hi if your salary is being attached in the chit fumd case then you could file civil revision petition questioning the action of the attachrment order on the ground that you stood also as a surety and could obtain relief
