Release of property papers given for surety

02-Feb-2023 (In Recovery Law)
In 2002, I stood surety for loan from Bank to my son with whom I have no relation now due to certain very unpleasant reasons. Said loan has since been fully cleared and rather it has little credit balance. But the status of account in Bank still remains C/C a/c. Despite writing to Bank for release of my property papers given at time of sanction, Bank not giving back papers saying that I should visit Bank along with borrower to get No Due Certificate then they will release the papers which is practically not possible. Presently nothing is payable to Bank and a/c has some credit balance. What should be the way out to get back property papers from Bank?

you can file a consumer case against the bank for realise of your property papers. else you can also file suit for mandatory injunction to get the papers. other way around is petition in high court. you can also move an application before banking ombudsman. you have certain options to get your property papers back.
