Refund of security deposit from hostel owner

My son was staying in U38 boys pg in sakarpur, Laxmi Nagar. Due to cancellation of board exams he back to Assam to his house. While leaving he informed the hostel warden and asked for security deposit of Rs 13000 but they said will pay soon. Now after three months also the owner of PG Mr Mayank Gupta is denying to refund the amount and said he will not return whatever you want to do, do it. He is cheating us I have payment slips and all WhatsApp communication messages are there. Now I need to take legal action against him.

Send him a legal notice for such act and also file a complaint against him for cheating so that he not only learns a lesson but also is barged to pay the money back.
