Recovery of the Recruitment Services catered to the client

We are a Recruitment consultant and have assisted one of our client for their Hiring needs. For the same the consulting charges are due since last 5 Months and the client is now not responding to the calls / sms / Emails. What can be the ideal process to be followed. What are the chances of the recovery of the amount, the client has lost the entire Infrastructure project but are Operational with 7-10 employees now limited to their head office in Delhi How much time it will take to recover the amount though when we have exchanged the agreement it was not discussed about the charges post in case not done the payment of signed 30 Days Also the Jurisdiction was not specified as the client is in Delhi and we are Operational in Uttar Pradesh. what are the Charges for the services provided

You can send them a legal notice and can initiate legal proceedings against them including recovery proceedings. Further the chances can be assessed only once the entire documents are read and reviewed.

First of all, the jurisdiction will be at Delhi unless other factors come into play. Now, you shall have to file a suit for recovery to recover your money. It does not matter whether they are operational with 10 employees or 100. Better sounding advice can be provided only after getting to know the contents of the contract/ agreement.

Any such transaction as described above squarely amounts to contract and can be enforced in a Court of law as such.

As for jurisdiction in such cases, it is that Court within the jurisdiction of which the head office of the defendant corporation is situated or where the cause of action has arisen. The address of working place of the plaintiff is of no consequence.

Where the existence of the contract and the subsequent breach is proved, it is just a matter of time when the court passes the decree. Additionally if succeeded the party is also entitled to compensation for late payment alongwith attorney charges, with the interest in the former.
