Recovery of the amount which was given to someone and he is not return

My family members have given some amount to someone and from past 2 months they are demanding to return the amount which they have given to him all the transactions were done through upi and know they asking to return the amount which they have given to him and he is saying i will give it to you by morning by afternoon by evening by today and
tomorrow he is just ranting this lines
Serve him a formal demand notice of 60 days
Then serve a legal notice of 30 days
Then file a recovery suit I. Civil court of your jurisdiction
Also call him over phone and STRICTLY DEMAND YOUR MONEY BACK and tell that you will drag him in to the Court and if he may hurl filthy abuses and give some threats then lodge a criminal FIR against him
