Recovery of money for non fulfillment of agreement

My family paid a sum of 7 lac rupees to a person to build the second floor of his house on lease. We have papers where both parties signature are there.The contract was for 10 years and then its written that the party will pay back the entire sum of money. Throught 10 years my family has to pay 2000 rs as rent to the party. Now the house was to be handed over by June 2016. Now the party is telling he cannot give the house and he will pay the money. Its been nearly 7 months and we still have not got back our money. What should we do ?

First of all I need to go through all the papers relating to aforesaid transaction then I would be able to give proper advice to you. If all the papers are o.k. you can file civil suit for recovery of your money or may file a case under specific performance of contract act
