Recovery from Hyderabad against court decree from Delhi

You are not required to file a fresh recovery suit. A decree can be executed where the judgment debtor resides, carries on business, or has assets. You should proceed as follows: 1. File an application under Section 39 CPC before the respective Delhi courts seeking transfer of the decrees to the competent court in Hyderabad. 2. Upon transfer, initiate execution proceedings in Hyderabad against the assets of the judgment debtors. Once before the Hyderabad court, you may seek: - Attachment of bank accounts and movable/immovable properties, - Garnishee proceedings against debtors of the judgment debtor, and - Other coercive measures permissible under law. Ensure you obtain certified copies of the decrees and confirm that they are executable and within limitation. Do not delay execution. A decree is valuable only when enforced promptly through proper procedure.
