Recover of advance from Banquet

Hi, my advance (50% of total amount) given for my wedding (scheduled in april 20, cancelled due to COVID) by my father is pending with banquet in delhi since 1.5 years.. they are not refunding the amount and always asked us to adjust with some other function (as I got married during the COVID time at the different venue as banquets were closed). Now when i approach them for a relative's wedding, the dates we ask for are booked. How can we recover the money? 90% of the advance was in cash so will the consumer forum entertain our matter. pls suggest

If the services have not been availed then you can claim the refund. Also the banquet if already offered you the adjustment and still not doing it then we can send a legal notice for recovery of the dues. U need to send legal notice to the owner of the hall …u shouldn’t wait so long for the same …I think u hv typed the question few months ago as well but hv not executed anything till date except delaying your own case ..

The banquet people must have given you some receipts regarding the booking of the hall at the time when you visited them for your wedding. That will be the enough evidence to prove that you had made a payment even if 90% was cash. But we have to first file a written legal notice to the banquet people.
