Private loan taken by one of our employees from Bank

08-Jan-2023 (In Recovery Law)
One of our employee has taken a loan of around Rs.9 lacs from a Bank. Our organization was not aware of such loan and we have never stood as Guarantor in any way. We are a private limited company. Now the concerned employee has not been repaying the loan to the Bank. The Bank has sent us an Interim Order through their Arbitrator, who has ordered our organization to debit a certain amount from the employee's salary every month and credit it to the Bank. Please advise are we bound by this order ? Or we can intimate to the bank that it was a private dealing between our employee and the bank and we are not bound to act upon its Interim Order.

Dear sir this order has passed by Arbitrator , there has been an agreement between you and the bank if you not repay there amount , they will excute the order , if execution has done then your company assets will attached by the court as well the authorised person of the company will arrested , now you have one option you challge this order before the court of law

Definitely you should go ahead and inform the Arbitrator that you were not aware of any such arrangement between your employee and the bank
If your property is mortgaged with the bank they are surely bound to come after you for the recovery of their loan
However as guarantor your organisation must have signed some documents or may be your employee must have got your signature on the same
Check that
