Not repaying the loan amount and fake excuses

11-Nov-2025 (In Recovery Law)
A woman asked me for money and I transferred it to her husband's bank account via upi. They started ignoring my calls after and partly repaid only after I contacted their owner. They bought a car in between but didn't repay my loan its almost a year now and they have given multiple excuses to avoid repayment and I suspect a fake death excuse as she herself admitted cheating one person before by non repaying

Dear Client, Since the money was transferred through UPI to the husband’s bank account, your transaction is legally traceable and verifiable evidence of debt. Their deliberate non-repayment despite repeated demands constitutes criminal breach of trust (Section 406 IPC/BNS 316) and cheating (Section 420 IPC/BNS 318). You should immediately issue a Legal Notice to both husband and wife demanding repayment within 7 days, clearly mentioning the transaction details and UPI proof. If they fail to comply, you can: 1️⃣ File a Police Complaint / FIR for cheating and misappropriation. 2️⃣ File a Private Complaint under Section 200 Cr.P.C. before the Magistrate with bank/UPI evidence. 3️⃣ Initiate a Civil Money Recovery Suit before the jurisdictional Court under the Negotiable Instruments Act or Contract Law. Their conduct—buying assets while evading repayment—shows malafide intention. A strong legal notice and follow-up complaint will compel repayment and prevent further fraud.

For recovery of amounts, limitation is three years from date of transfer, hence you need to hurry up. You should file recovery suit before proper court, for your amount. As it is via UPI, proving is easy for you
