25-Feb-2023 (In Recovery Law)

Hi, please a advice. Someone has a home loan. Not paid for 20 EMis. NPA letter was received last month. They have asked bank to sell the property and take their money and give rest to them. Property is in forceful possession by third party. Whats the process to be followed by bank. Can bank take possession and sell? Replies will be appreciated. Thanks.

Yes bank can take the possession under the circumstances. A property mortgaged to the bank there csnno be further encumbrance without the permission of bank. The bank with legal proceedings will recover the property from third party.
