Not able to recover money for 5 yrs

16-Mar-2026 (In Recovery Law)
I have nearly paid around 3 lakh towards a loan sanction, with the individual involved still in contact with me. Despite almost five years passing, I have not been able to recover the amount. However, I have transferred funds to his account. He subsequently transferred the money to a person who was a bank manager; that individual is now retired. Currently, I am in regular contact with him, and he repeatedly gives me assurances with specific dates, often delaying without concrete action.

If you have transferred about ₹3 lakh to a person on the assurance of arranging a loan and the amount has not been returned even after several years, the matter may amount to cheating and criminal breach of trust. Since you have bank transfer proof and the person is still in contact, you have legal remedies. First, send a legal notice demanding repayment of the amount within a fixed time. If he fails to repay, you may file a criminal complaint for cheating under the Bharatiya Nyaya Sanhita, 2023 before the local police. You can also file a civil recovery suit to claim the amount along with interest. Collect all evidence such as bank transfer records, messages, call recordings, or any written assurances. Even if the money was transferred to another person like a bank manager, both persons can be made parties in the complaint if they acted together. Prompt legal action will help in recovery and investigation.

Send Legal Notice Through lawyer demanding payment (important first step) ✔️ 2. File Case (depending on situation) ➤ Civil Suit for Recovery If limitation can be justified ➤ Criminal Case (if cheating) Relevant sections: Cheating (Section 420 IPC) Criminal breach of trust (Section 406 IPC) ✔️ 3. Summary Suit (Order 37 CPC) Faster recovery if you have written proof like: Agreement Cheque Promissory note

my dear you are not within the limitation you need to file a case within 3 years of any transaction happened, if you want to file a civil case for recovery for it so now you can try and file an FIR, also there is a trick to it you can send another thousand to the person and then claim a case that this money was within included in that 3 lakh rupees and it was an additional transaction so you are limitation starts from that thousand rupees transaction, also you can file civil case for recovery after the limitation is satisfied and before filing a case you need to give a legal notice that you are finding also, if you can directly contact to the bank person and ask for money or else his all pension and retirement fund will be taken back if he is not giving your money back

Please specify amount was given for what purpose and you can issue a legal notice for recovery of the same and police complaint can be filed. Please share proper documents and information for proper legal advice. You need to act fast as 3 years is the limitation period for filing of recovery suit as well. Your claim will become time barred if action is not taken immediately

File a police complaint for cheating (IPC 420). Send legal notice for recovery. Also file civil suit for recovery with interest. Collect bank proof. Don’t delay further as limitation may apply as per the concerned provisions of law
