Non Payment of Dues by a company

01-Aug-2026 (In Recovery Law)
Hi, I need Lawyer's advice on how to address the non payment of dues by a company for the MoU signed regarding investment option. As per the MoU a fixed monthly payment was to be made based on the investment amount. However, that amount has not been paid for over 12 months now. The initial relationship was built over online sharing of draft agreements and brochures. Is there any foolproof way to recover the funds from this company without losing a lot of capital?

Based on the facts stated, you should first issue a detailed legal notice to the company demanding payment of all outstanding dues with interest within a specified period. Preserve the MoU, payment records, emails, messages, brochures, and all communications as evidence. If the company fails to comply, you may initiate a civil suit for recovery of money and damages for breach of contract. I

A company's failure to honour its obligations under an MoU does not leave you without a remedy. Immediately issue a comprehensive legal notice demanding payment of all outstanding dues along with applicable interest. If the default continues, initiate appropriate civil recovery proceedings or arbitration, if provided under the MoU. Where the facts disclose fraudulent inducement or dishonest intention from the inception of the transaction, appropriate criminal proceedings may also be maintainable. Preserve the MoU, investment proofs, bank records, emails, brochures, and all communications, as these documents will be crucial for enforcing your contractual and legal rights.
